General Terms and Conditions of Business and Use of the website www.greengoldbrewing.com

The General Terms and Conditions of the website owned by Green Gold d.o.o. have been prepared in accordance with the Consumer Protection Act (ZVPot), based on the recommendations of the Chamber of Commerce and Industry of Slovenia (GZS) and international recommendations for e-commerce.

By using this website (hereinafter referred to as the “website”), you agree to the following General Terms and Conditions. These General Terms and Conditions apply to your use of this website, to every order placed through the website, to every purchase made through the website, and to every agreement between you and Green Gold d.o.o. (www.greengoldbrewing.com).

The website www.greengoldbrewing.com (hereinafter referred to as the “website”) is operated by Green Gold d.o.o. (hereinafter referred to as the “provider”).

Registration:

When registering for the online store, the user selects a username and password. The username is a valid email address, while the password is chosen by the user. The user’s email address and password are linked to the information entered by the user. We therefore ask you to ensure that you provide accurate and correct information, as this is the only way we can notify you of any changes regarding products or your order.

The provider thereby enables easier purchases and browsing of the website while ensuring the protection of data, which will be used in accordance with all the terms of use of the website listed below and accepted by the user. The General Terms and Conditions define the rights and obligations of the provider and the user and their mutual relationship.

Availability of Information:

c) the essential characteristics of the goods or services (including after-sales services and warranties)

f) all prices must be clearly and unambiguously stated, including whether they already include taxes and transport costs
g) payment and delivery methods

i) the period during which it is possible to withdraw from the contract and the conditions for withdrawal; as well as information on whether and how much the return of the product will cost the customer
j) an explanation of the complaints procedure, including all contact details of the person or department responsible for customer communication

Product Offer:

The website is updated as quickly as possible. If products are out of stock, this is clearly indicated on the website.

Payment Methods:

For online purchases, the provider offers the following payment methods:

– payment via PayPal
– payment by credit card (MasterCard, Visa, etc.)

An invoice clearly stating the purchase costs will be included with the ordered products. Information regarding the right of withdrawal and the method of returning goods is explained in more detail under the section “Return of Goods”. You can track the status of your order on the “My Account” page, where you can also manage your information.

Validity of Offers and Product Prices:

All prices in the online store greengoldbrewing.com are stated in euros, include VAT and have been valid since 1 August 2018. Prices are final and apply on the date and at the time the order is confirmed. The provider may change prices without prior notice. Promotional prices are valid until the stated date or until withdrawn. Discounts and promotions cannot be combined. The entire offer is valid until further notice. Prices do not include delivery costs.

Shipping:

If the order value is EUR 100 or more, shipping costs are covered by the online store greengoldbrewing.com. Otherwise, shipping costs are borne by the customer.

Delivery outside Slovenia is arranged by prior agreement and is charged according to a special tariff. The customer is also responsible for any applicable duties or charges in countries outside Slovenia.

Product Delivery and Delivery Period:

The online store greengoldbrewing.com undertakes to dispatch ordered products as soon as possible. Orders for products marked with a 24-hour delivery period that are received on a working day before 1:00 PM will be dispatched on the same day or, at the latest, on the following working day. If a particular product is out of stock and delivery will therefore take longer than three working days, we will notify you by telephone or email. We therefore ask you to enter your information accurately when registering in the online store. Products ordered through the online store greengoldbrewing.com are delivered by Pošta Slovenije.

An order is considered a valid sales contract, which is stored electronically on the provider’s server. The customer also receives an invoice with the order. The provider reserves the right, if a customer has previously placed an order with cash on delivery and failed to collect the package, resulting in its return to the provider, to require payment in advance before dispatching any future order.

Prices:

Prices already include 22% VAT. Prices applicable at the time the order is placed may be changed by the provider at its discretion. Prices apply when payment is made using the payment methods listed above and under the conditions stated above. The sales contract between the provider and the customer is concluded when the provider confirms the order (the customer receives an email regarding the order status). From that moment, the prices and terms are binding on both the provider and the customer.

Promotional Coupons:

From time to time, the provider may issue special promotional coupons to customers via email or Facebook activities. These coupons may provide gifts with purchases or discounts on all products or individual products. All promotional coupons are valid for a limited period and expire after the specified period. One customer may use only one promotional coupon per purchase. Coupons cannot be combined and cannot be exchanged for anything else (e.g. a discount on another product, free shipping, etc.).

Withdrawal from the Sales Contract:

For contracts concluded at a distance, the consumer has the right, pursuant to Article 43.c of the Consumer Protection Act (ZVPot), to notify the company by email at info@greengoldbrewing.com within fifteen (15) days that they are withdrawing from the contract, without having to provide a reason for their decision.

The customer may return the received goods in their original condition, undamaged and unopened, to Green Gold d.o.o., Sp. Grušovlje 2, 3311 Šempeter v Sav. dol., which shall be deemed as withdrawal from the contract.

If the customer notifies the provider that they intend to withdraw from the purchase and return the goods, they have 15 days to send the goods back to the provider. The cost of returning the goods is borne by the customer, while all other costs are covered by the provider. We do not accept parcels sent cash on delivery. The refund will be transferred to the customer’s bank account within 30 days of receiving the returned goods. When products are returned, the purchase price of the products is refunded, excluding the cost of returning the goods to the provider.

When returning the goods, the customer must also provide the invoice for the goods, their personal information and the bank account to which they wish to receive the refund. The customer is required to notify the provider by email at info@greengoldbrewing.com within 15 days of receiving the goods that they intend to return them. Otherwise, the return will not be accepted and the money cannot be refunded.

Protection of Personal Data:

The provider undertakes to permanently protect all personal data of the user. The provider will use personal data exclusively for the purposes of processing orders, sending information about news, promotions and benefits, issuing invoices and other notifications, and other necessary communication. Under no circumstances will the user’s data be disclosed to unauthorized persons.

The user is also responsible for protecting their personal data by ensuring the security of their username and password.

Communication:

The provider will contact the user by email or telephone unless the user expressly objects to such communication.

Promotional emails shall contain the following elements: they shall be clearly and unambiguously identified as advertising messages, the sender shall be clearly identifiable, and various promotions, campaigns and other marketing techniques shall be identified as such, with the conditions of participation clearly stated. The method of unsubscribing from advertising messages shall also be clearly presented. The provider shall expressly respect the user’s wish not to receive advertising messages.

Gifts with Purchases:

If the customer makes a purchase and receives a gift with the purchase, and subsequently decides to return the purchased goods, they must also return the gift, with both the goods and the gift being returned in their original condition.

Gifts include anything provided with the purchase, except documents (e.g. smaller quantities of products, etc.). If the customer returns the purchased goods but not the gift, the value of the gift will be deducted from the amount refunded to the customer.

Free gifts are not exchanged and their value is not refunded (in the event of damage, unsuitability, etc.).

Legal Notice:

The greengoldbrewing.com website and all information contained therein (product images, graphics, texts and everything else) are protected by copyright law and may not be reproduced or used without the prior written permission of the provider.

Obligations and Responsibilities:

The online store greengoldbrewing.com strives to ensure that the information published on the store’s website is up to date and accurate. However, product characteristics, availability and prices may change so quickly that we may not be able to update the information in the online store in time. In such cases, we will subsequently notify the customer of the changes and allow them to cancel the order or replace the ordered product.

Product photographs generally show the actual appearance of the product. However, in some cases they may be symbolic and do not necessarily guarantee the actual appearance or characteristics of the product.

We reserve the right to correct errors in text or typographical errors.

The online store greengoldbrewing.com reserves the right to change these General Terms and Conditions at any time and in any manner without prior notice.

Complaints and Disputes:

The provider and the customer agree to resolve any disputes between themselves with understanding, respect and a great deal of patience.

In the event of complaints, claims or comments, the customer is required to first submit their complaint to the provider in writing by email at info@greengoldbrewing.com. All complaints shall be treated confidentially.

The provider will make every effort to resolve all disputes reasonably and in the customer’s best interests. Upon receiving a complaint, the provider shall notify the customer as soon as possible that the complaint has been received and inform them how long the resolution process is expected to take.

The customer and the provider undertake to resolve any disputes amicably. If this is not possible, the dispute shall be resolved before the competent court.

In accordance with applicable legislation, we do not recognize any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer could initiate pursuant to the Alternative Dispute Resolution Act.

Notifications and Newsletters:

The user agrees that, by subscribing to the newsletter, they may occasionally receive information about website updates, new products and promotional campaigns. The provider undertakes not to misuse the user’s email address in any way or disclose it to third parties. The user may unsubscribe from receiving newsletters at any time.

By using this website (hereinafter referred to as the “website”), you agree to the following General Terms and Conditions. These General Terms and Conditions apply to your use of this website, to every order placed through the website, to every purchase made through the website, and to every agreement between you and Green Gold d.o.o. Intellectual Property Rights:

This website and all material contained on it, including but not limited to images, texts, photographs, graphics, icons and illustrations, except for material already covered by existing copyrights and other intellectual property protections, are owned by Green Gold d.o.o. and/or its owners, subsidiaries or affiliates.

Reproduction, publication, modification, uploading, transmission, distribution or public display of material from this website requires written permission from Green Gold d.o.o.

Green Gold d.o.o. offers and sells products only to residents of Slovenia and ships packages to addresses in Slovenia.

This provision shall remain in effect even after termination of these Terms for any reason.

Purchases:

If you wish to purchase products described on the website, you may be required to provide certain information, including but not limited to credit card or other payment information.

You acknowledge that all such information will be treated confidentially by Green Gold d.o.o. You agree that all information you provide will be accurate and complete.

You agree to pay all charges incurred through the use of your account and credit card or other payment method at the prices applicable when such charges are incurred.

You will also be responsible for paying all applicable taxes or duties, in addition to VAT, relating to your purchases. Prices displayed on the website are in euros and include VAT.

Letters, Questions and Comments:

You agree that by submitting questions to Green Gold d.o.o., either in writing or by email, you grant Green Gold d.o.o., free of charge, a perpetual, irrevocable, non-exclusive, worldwide right and license to use, reproduce, transmit, modify, adapt, publish, display, distribute, translate and sublicense such material, in whole or in part, and/or incorporate such material into other works in any form, media or technology, whether now known or later developed, for the entire term of any copyrights that may exist in such material.

Furthermore, by submitting content to Green Gold d.o.o., you warrant that you have the authority to grant such rights and that the content you submit will not infringe any rights of any third party, including but not limited to copyrights, trademarks and privacy rights.

Password Use:

Use of any password-protected part of the website is restricted to the individual who has been given permission and a password to access that area (the “authorized party”).

Passwords may not be shared with others, and the authorized person is responsible for any damage caused to Green Gold d.o.o. as a result of distributing their password.

Changes:

Green Gold d.o.o. has the right at any time to:

(a) amend the terms of these Terms;
(b) modify the website, including removing or discontinuing any website content or features, limiting the period of availability or limiting the amount of permitted use; or
(c) change any fees or charges for use of the website, including introducing new or increased fees or charges for use of the website or any other related services or features.

Green Gold d.o.o. may amend this agreement at any time by publishing the amended Terms on this website. Your continued use of the website shall be deemed acceptance of the amended Terms.

Miscellaneous:

You agree that these Terms have entered into force in Slovenia and shall be governed by and construed in accordance with Slovenian law.

Each party to this agreement acknowledges the exclusive jurisdiction of the courts in Ljubljana, Slovenia, and waives any objections regarding jurisdiction, venue or other matters concerning such courts.

In any action to enforce this agreement, the prevailing party shall be entitled to recover costs and attorneys’ fees.

If any provision of this agreement is determined by a court, tribunal or other competent authority to be unenforceable, that provision shall be limited or removed to the minimum extent necessary so that these Terms remain in full force and effect.

These Terms constitute the entire agreement between the parties relating to the subject matter of these Terms, and all prior written or oral agreements between the parties are superseded by these Terms.

A waiver by either party of any breach shall not constitute a waiver of any previous or subsequent breach or failure to perform an obligation.

Video Surveillance:

• The operator of the video surveillance system in the warehouse premises is Green Gold d.o.o.

• Video surveillance is carried out pursuant to Article 78 of the Personal Data Protection Act (ZVOP-2), exclusively in areas where goods are stored, for the purpose of ensuring the safety of people and property, preventing workplace accidents when handling goods, and preventing theft or unauthorized removal of goods.

• Video recordings contain an image, location data, and the date and time of the recording, and are retained for 1 year from the date the recording was made.

• For the purpose of exercising individual rights relating to personal data protection, including a request for access to their own video recording, an individual may contact the data controller by email at info@greengoldbrewing.com or by telephone at +386 41 892 592.

• An individual has the right to submit a complaint regarding the video recording to the director of Green Gold d.o.o.
